The general terms and conditions of sale detailed below govern the contractual relationship between the User (hereafter referred to as You) and the Internet Activities S.A. company (hereafter referred to as We) and both parties accept these conditions unreservedly. These general conditions of sale are the only conditions that are applicable and replace all other conditions, except in the case of express, written prior dispensation. We maintain that, by confirming your order, you unreservedly accept our general conditions of sale, having read them. These Terms and Conditions of Sale are important to you and Internet Activities Ltd. as they have been designed to protect your rights as a valued customer and to protect our rights as a business and to create an understanding between us.
2. Your order

Prices

The photographs illustrating the products are not part of the contract. If there are any errors in them, we may in no way be held liable for this. 6. Delivery
We deliver in most of the countries in the world. Shipment is done via LA POSTE FRANCE.

Upon receipt of your order, please ensure that the device is in good working order. If there are any apparent faults, the buyer shall be entitled to return the product under the conditions set down in the present document. The vendor is exempted from his/her obligation to deliver in the event of war, riots, fire, strikes, accidents and in the event that he/she finds it impossible to obtain supplies. Goods are always transported at the risk of the consignee.

Damage in transit: You must always check your package upon arrival. If goods arrive in a damaged condition you must make a note on the carrier's delivery consignment note before the driver leaves and it will be your responsibility to inform us within 48 hours of delivery.

7. Faulty Goods
We will replace, refund or repair faulty products if they are deemed to be faulty on arrival. All potential faulty products will be examined by our after-sales service to get a first technical diagnostic. If we are unable to detect a fault, it may be necessary for us to return the goods to the manufacturer for confirmation before we are able to either repair them or supply a replacement. No replacement will be authorized if accessories and instructions are missing and/or the product is receive damaged and/or the product comes without the original packaging.
8. Availability
Our web site is regularly updated throughout the day, to ensure that we provide accurate details on product availability and the listed time limit is regularly updated. We endeavour to ensure availability on all our advertised items is constant, however we cannot warranty availability.
In the unlikely event that your chosen item is unavailable we will contact you ASAP to advise of expected delivery dates.

9. Payment
- Online payment via major credit cards: Visa, Eurocard-Mastercard, Switch and Solo: by means of a secure payment system (your card is charged at the day of your order for security reasons).

- Bank transfer payment: Internet Activities Ltd offers the opportunity to pay by bank transfer. Please note that Bank transfers from abroad will only be accepted if the additional transfer costs are paid by the customer.
Your payment will be processed when your bank transfer is received. Once your payment received we will dispatch your goods. The processing of off-line payments may take several days.



Please note that if our insurance company and our fraud department suspect a fraud we reserve the right to cancel a transaction for security purposes.
10. Security Check - Insurance Policy
Please note that some delay may occur in your delivery: Due to insurance policy, every single order goes through a security check. Complementary information will be required by e-mail or fax in order to validate your order.
Consequently, in order to proceed with your order, we would need the following details from you:

11. Legislation
This contract shall come under luxembourgeoise law held liable for any kind of damages, material, immaterial or corporal, that arise as a result of the malfunctioning or misuse of commercial products. The same shall apply where any alterations are made to products by their manufacturers. Our liability shall, in any case, be limited to the setting up of the order and we may not be held liable in the event of simple errors or omissions which may occur in spite of all the precautions taken in presenting the products. In the event of a dispute, our customer services division is at your disposal with the aim of reaching the fairest, amicable settlement. Failing this, the Tribunal Of United Kingdom Court shall be the only court with jurisdiction to rule on such disputes, regardless of the place of delivery or accepted method of payment.

 

12.Taxes specific to the States of destination
We carry expressly to your attention that our prices do not contain a taxation specific to the States like the taxes of the royalties, of the customs duties special, etc the conditions of a possible payment of these taxes just like their amount are different in the various States. For example for France the amount of Sorecop net of tax for the CD-R are 0,352€ and for the DVD-R 1,589€ for each one. If it would be necessary to pay such taxes in a State, it is exclusively the customer who of it is responsible in his quality for importer.

 

13. Legal information
Since the details you give us are essential for the processing and delivery of orders, for billing and for the establishment of warranty contracts, failure to provide these details will result in the cancellation of your order. You have the right to access, change, correct and remove any data held about yourself, and can do so simply by request to our customer service division. The ONLY information we collect are the details you provide to us so as we can process your order, for example, name, address, credit card details. All information is collected lawfully.

14. Product availability
The order shall be fulfilled within a period of 30 days at the latest, starting from the day following that on which the customer placed the order.
In the event of an ordered product being unavailable, in particular if this is due to our suppliers, the customer shall be informed thereof at the earliest opportunity, and shall have the option of cancelling the order.

The customer is required to check the condition of the packaging of the goods upon arrival, and to report any damage attributable to the carrier on the delivery note and to Internet Activities S.A., within a period of one week.
15. Delivery problems attributable to carrier
Any problem with the delivery (damage, absence of a product or products listed on the delivery note, damaged package or broken products etc.) must, without fail, be reported on the delivery note in the form of a "written reservation", and accompanied by the customer's signature. The customer shall also be required to confirm this problem by sending the carrier a recorded delivery letter with confirmation of delivery within two (2) working days following the delivery date, detailing the aforementioned complaints.

16. Delivery errors
16-a: : The customer shall be required to lodge any complaint concerning an error in delivery and/or non-compliance of the products in terms of nature or quality with the instructions given on the order form with Internet Activities S.A. on the same day as the delivery or, at the latest, on the first working day after the delivery. Any complaint made after this period shall be rejected.

16-c:Any complaint not made in accordance with the rules set out above and within the time limits stated shall not be taken into account and shall release Internet Activities from all liability with regard to the customer.
16-d: Upon receipt of the complaint, Internet ctivities S.A. shall allocate an exchange number for the product(s) concerned and shall inform the customer thereof by email, fax or telephone. A product may only be exchanged after the customer has been allocated an exchange number in the manner described above.
16-e: In the event of an error in delivery or exchange, any product to be exchanged or returned shall be required to be returned to CONSUDISCOUNT in its entirety, and in its original packaging, by parcel post, at the following address:

17. Right of withdrawal

The customer shall have a period of 7 working days in which to return, at his/her own expense, any products failing to meet with his/her satisfaction. This period shall run from the date on which the customer's order was delivered. In the event of this period ending on a Saturday, Sunday or a bank holiday, it shall be extended to the first working day thereafter.

Only those products returned in their entirety, in their original packaging, complete and intact, and in perfect resale condition shall be accepted. Any product that has been damaged or whose original packaging has been damaged shall not be eligible for refund or exchange.
This right of withdrawal may be exercised without penalty, with the exception of the costs of return. In the event of exercising this right of withdrawal, the customer has the choice of requesting either a refund of the sums paid, or that the product be exchanged. In the event of an exchange, the charges for shipping the new product shall be borne by the customer.
Where the right of withdrawal is exercised, Internet Activitties Ltd shall make every effort to reimburse the customer within 30 days.
The customer shall then be reimbursed by means of a credit to his/her bank account .
